Legal challenge on Levelling Up Fund to proceed

The High Court has granted permission for a legal challenge to the Levelling Up Fund, which the Good Law Project argues is funnelling money into constituencies of political benefit to the Conservative Party.

This permission decision means the government will have to defend itself in Court.

Earlier this year the Budget confirmed ‘Towns Fund’ funding for 45 towns of which 40 are represented by at least one Conservative MP. It also introduced the Levelling Up Fund, which operates from ‘a new, and troublingly opaque, set of criteria’. According to its critics, those criteria boost the funding prospects of wealthier towns represented by Tory MPs.

The Public Accounts Committee has also accused the government of a ‘lack of transparency’ in a report on the Towns Fund.

Of the 14 cases the Good Law Project has issued since the start of 2020, the Court has granted permission in 11 at the first time of asking.
